TERMS OF SERVICE FOR MEDIA GRAB ADD-ON Thank you for using Media Grab, an add-on. Please read these terms of service carefully before using this add-on. By using Media Grab, you agree to be bound by these terms and conditions. 1. User Responsibilities 1.1. You acknowledge and agree that you are solely responsible for your use of Media Grab. 1.2. You agree to use Media Grab only for lawful purposes and in compliance with all applicable laws and regulations. 1.3. You agree not to use Media Grab to download or distribute copyrighted or otherwise protected material without the owner’s permission. 1.4. You agree not to use Media Grab to harvest or collect any personally identifiable information, including names, email addresses, or phone numbers, without the consent of the individuals concerned. 1.5. You agree to use Media Grab at your own risk and understand that the developer is not responsible for any damage or loss caused by your use of the add-on. 2. Intellectual Property Rights 2.1. The Media Grab add-on, including its design, features, and functionality, is the property of the developer and is protected by copyright, trademark, and other intellectual property laws. 2.2. You may not copy, modify, distribute, or create derivative works based on the Media Grab add-on without the express written permission of the developer. 2.3. You acknowledge that Media Grab may access, store, and use data collected from your use of the add-on, including website URLs, image files, user settings, and your IP address. You grant the developer a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use this data for the purposes of improving and marketing the add-on. 3. Limitation of Liability 3.1. You agree that the developer shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages resulting from your use of Media Grab. 3.2. The developer makes no warranties or representations about the accuracy, completeness, or reliability of the add-on or its content, including any images or data downloaded through Media Grab. 4. Indemnification 4.1. You agree to indemnify and hold harmless the developer, its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of Media Grab or your violation of these terms of service. 5. Governing Law 5.1. These terms of service shall be governed by and construed in accordance with the laws of the state in which the developer is located, without regard to its conflicts of law provisions. 5.2. Any dispute arising out of or related to these terms of service or your use of Media Grab shall be submitted to confidential arbitration in the state in which the developer is located, except that, to the extent you have in any manner violated or threatened to violate the developer's intellectual property rights, the developer may seek injunctive or other appropriate relief in any court in the world. 6. Modification 6.1. The developer reserves the right, at its sole discretion, to modify or replace these terms of service at any time. 6.2. If the developer makes any material changes to these terms of service, it will notify you by email or by posting a notice on the Media Grab website. 7. Termination 7.1. The developer may terminate your access to Media Grab at any time without notice or liability. 7.2. Upon termination, you must immediately stop using Media Grab and destroy any downloaded or printed materials obtained through the use of the add-on. 7.3. The termination of your access to Media Grab shall not relieve you of any obligations arising or accruing prior to such termination. 8. Miscellaneous 8.1. These terms of service constitute the entire agreement between you and the developer with respect to the use of Media Grab and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and the developer. 8.2. If any provision of these terms of service is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. 8.3. The failure of the developer to enforce any right or provision of these terms of service shall not be deemed a waiver of such right or provision. By accepting these terms of service, you acknowledge that you have read, understood, and agree to be bound by all the terms and conditions stated herein. If you do not agree to these terms, you may not use Media Grab.
